Repeal of Show Me the Water

WR-8 WATER AVAILABILITY to be heard by the Water Resource Committee

DESCRIPTION: The Committee is in receipt of County Communication 11-306, from

Councilmember Michael P. Victorino, transmitting a draft bill entitled “A BILL FOR AN

ORDINANCE AMENDING ARTICLE 1 OF TITLE 14, MAUI COUNTY CODE, AND

TITLE 18, MAUI COUNTY CODE, RELATING TO WATER AVAILABILITY”. The purposes of the draft bill are to amend Title 14, Maui County Code (“MCC”), to

(1) allow an engineering report accepted by the Department of Health to constitute proof of a long-term reliable source of water;

(2) exempt large-lot subdivisions and water source development agreements with private entities from the provisions of Chapter 14.12, MCC;  

(3) make discretionary the Director of Water Supply’s consideration of the provisions in Section 14.12.050,MCC, when reviewing an engineering report; and

(4) provide that Chapter 14.12, MCC, shall expire two years from the effective date of the ordinance.

STATUS: The Committee may consider whether to recommend passage of the draft bill on first reading, with or without revisions. The Committee may also consider the filing of County Communication 11-306 and  other related action.
